TERMS AND CONDITIONS OF SERVICE

1. Introduction
These Terms and Conditions govern the provision of tutoring services by Zenshin Educational ("we", "us", "our") to students and parents/carers ("you", "your").
By booking lessons with Zenshin Educational, you agree to these Terms and Conditions.
2. Services
Zenshin Educational provides tuition in Mathematics, English and other agreed subjects for students from Reception to Year 8.
Lessons may be delivered:
- Normally in person
- Occasionally online via video conferencing software
- Via independent learning programmes
We aim to provide high-quality educational support but cannot guarantee specific examination results or academic outcomes.
3. Free Assessments
Initial free assessments will be conducted before tuition begins.
Assessment results are intended to identify strengths, weaknesses and appropriate starting points for lthe student.
Assessment outcomes are professional opinions and should not be regarded as formal educational diagnoses.
4. Fees and Payment
4.1 Lesson Fees
Current tuition fees will be provided before enrolment.
Fees may be reviewed periodically. Existing clients will be given at least 30 days' notice of any fee changes.
4.2 Payment Terms
Invoices must be paid monthly, in advance, on the 1st of the month.
Payment may be made by:
- Bank transfer
- Standing order
- Other agreed payment methods
Failure to make payment may result in the suspension of tuition services.
5. Cancellation and Rescheduling
5.1 Parent Cancellation
One month's notice is required to cancel attendance.
Where students are unable to attend a class, 24 hours' notice is expected, so that arrangements may be made to deliver homework to the student.
5.2 Tutor Cancellation
If we need to cancel a lesson, homework will be provided and an alternative lesson or method of delivery may be offered.
5.3 Missed Lessons
Lessons missed without notice are non-refundable.
6. Attendance
Students should:
- Arrive on time
- Bring required materials, including completed homework
- Participate respectfully
Arrival is possible up to 45 minutes befor the session finishing time. Late arrival does not extend the scheduled lesson time.
7. Online Tuition
For online lessons:
- Students must have access to a suitable device and internet connection.
- Parents are responsible for ensuring equipment is functioning correctly.
- We are not responsible for interruptions caused by technical issues beyond our control.
Sessions may occasionally be rescheduled due to significant technical failures.
8. Parental Responsibilities
Parental support is vital in the successful outcomes for their children. Remember you are paying for your child to succeed. The best way to achieve success is by adhering to some simple principles.
Parents/carers agree to:
- Provide accurate contact information.
- Ensure students have a suitable learning environment at home.
- Inform us of any relevant educational needs.
- Communicate any concerns promptly.
- Try to establish a routine for completing homework. Without this, children will often try to find ways of avoiding homework in favour of TikTok or TV!
- Refer students back to given examples rather than try to explain the answers, so that students can work out the solution to problems themselves and develop their independent learning skills.
- Mark students homework as soon as possible after the work is completed, using the answer books provided. If students think that parents don't care, they are likely to ask themselves "Why should I?"
- Ensure corrections are done. This helps children learn and avoids making the same mistakes again and again. It also slows down progress, which is also a waste of money.
- Praise students every day for achieving 100% success.
- Encourage children to read every day. Without doubt this will prove to be a key factor in a child's educational development.
9. Safeguarding
Zenshin Educational is committed to safeguarding children and young people. DBS checks are in place.
All tutoring services are delivered in accordance with our Safeguarding Policy.
Parents should ensure an appropriate adult is available nearby during online sessions with younger children.
Any safeguarding concerns will be managed in accordance with our safeguarding procedures and legal obligations.
10. Behaviour
Students are expected to behave respectfully.
Although in over 10 years, this has never been an issue, we reserve the right to terminate tuition where behaviour is:
- Abusive
- Threatening
- Disruptive
- Inappropriate towards staff or other students
No refund will be provided where tuition is terminated due to serious misconduct.
11. Educational Outcomes
While we strive to support academic progress, we do not guarantee:
- SATs results
- School admission outcomes
- 11+ examination outcomes
- Specific grades or score improvements, although we expect that within 12 months all students will achieve a level at least equivalent to the average of their peer group. A level higher than average is to be expected
Student progress depends on many factors including attendance, completion of daily homework and parental support.
12. Intellectual Property
All learning materials, worksheets, assessments and resources remain the property of Zenshin Educational unless otherwise stated.
Materials are supplied for personal educational use only and may not be copied, distributed, sold or shared without written permission.
13. Confidentiality
Information provided by parents and students will be treated confidentially except where:
- Disclosure is required by law;
- Disclosure is necessary to protect a child or vulnerable person;
- Disclosure is required for safeguarding purposes.
14. Data Protection
Personal data will be processed in accordance with UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

15. Limitation of Liability
To the fullest extent permitted by law:
- Zenshin Educational shall not be liable for indirect or consequential losses.
- Our total liability shall not exceed the fees paid for the affected services.
- Nothing in these Terms excludes liability for death, personal injury, fraud or any liability that cannot legally be excluded.
16. Termination
Either party may terminate tuition by providing one month's written notice.
Outstanding fees remain payable upon termination.
We reserve the right to terminate services immediately where safeguarding, safety or conduct concerns arise.
17. Complaints
Any complaints should be submitted in writing to:

We aim to acknowledge complaints within 5 working days and investigate promptly.
18. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
